Ministry of Home affairs announce official implementation of Citizenship Amendment Act-2019 on March 11 2024. After a long wait of 5 years CAA 2024 is ready to turn into reality. Amit Shah, Home Minister of India took to X to finally open application process for lakhs of expedites who seek refuge in India. All those who are eligible under CAA-2019 can now apply on the official portal and get Indian Citizenship. Specifically aimed at benefiting non-Muslim migrants, the act applies to expedites of Pakistan, Bangladesh and Afghanistan. Since these countries are dominated by Muslim population, non-Muslim expedites seek refuge in India.

MHA announce an all-new designated portal for CAA 2024 applications. All those who are eligible to acquire citizenship under CAA 2019 can now apply on official portal. Applications shall be accepted online only. There is no end date for applications.

What is CAA (Citizenship Amendment Act)?

CAA bill was introduced in Lok Sabha on 9 December 2016, got passed on December 10th. Later on, got passed in Rajya Sabha on 11th December. The Bill originally seeks to amend Citizenship Act 1955 which deals with the conditions by which a person holds nationality of India. According to this Act any person born in India between 1950 and 1987 automatically acquire Indian citizenship irrespective of the nationality of their parents. And similarly, those born between 1987 to 2004 also become Indian citizens if any one of their parents is an Indian citizen. There is a provision of voluntary acquisition of citizen, relinquishment, dual citizenship and even overseas citizenship. Minimum requirement for citizenship by naturalisation is that the person must have stayed in India for the past 12 years. 

Now CAA 2019  allows migrants from Pakistan, Bangladesh and Afghanistan who belong to religious minorities of those countries (like Hindu, Sikh, Parsi, Buddhist, Jain and other non-Muslims) to get Indian Citizenship. Those who arrive in India on or before 2014 are eligible if they have spent last 5 years in India. The idea behind this religious discrimination is that since these neighbouring countries are highly Muslim dominated it is almost impossible that Muslims shall face any religious persecution for which they need to seek refuge from India. 

However, it is to be noted that migrants residing in Schedule tribe dominated and Tribal areas  like parts of Assam, Tripura, Mizoram and whole of  Meghalaya shall not get such opportunity since it will threaten the residential communities status.

How can one accquire Indian Citizenship?

According to Indian Citizenship Act 1955, following sections deal with provision of Indian citizenship:

If  a foreigner wants to become citizen of India they shall apply for it under section 5 and 6. There are certain conditions that they have to satisfy like time period of 12 years according to old regime.

About CAA-2019

CAA made some changes in Section 2, 7(d),18,3rd Schedule  of Citizenship act 1955  and add section 6B. CAA Rules in India

Section 6A Add All the provisions of section 6B shall not apply to Tribal areas of Assam, Meghalaya, Mizoram or Tripura (those states included in 6th Schedule)
Section 7D Added empower the Government of India to cancel the registration as overseas citizen of India in case of violation of the provisions of this Act or any other law for the time being in force after giving adequate opportunity of being

heard.

 

What is CAA 2024?What is the New CAA Law in India?

New CAA law in India is a continuation and final implementation of CAA 2019 for migrants from neighbouring countries.

CAA 2024 allows all those who are eligible to become Indian citizens under CAA 2019 to apply for Indian citizenship under Citizenship Amendment Act. However all these candidates need to belong to one of 3 countries i.e Afghanistan, Pakistan and Bangladesh. There is a certain eligibility criteria that they need to satisfy. then finally thay can go to official CAA portal to apply. Fill details, upload required documents and pay Rs 50/- online.

Print this application and submit it in the office of District collector/District Magistrate/Deputy Commissioner of your area. The applicant can check status of their application on the same website by filling their application number. They also get SMS notification about the same.

  • A copy of any one of the document in Schedule 1A ( Annexure – 1)
  • A copy of any one of the document in Schedule 1B ( Annexure – 2)
  • An Affidavit in format as in Schedule 1C ( Annexure – 3) All documents available on official site. Check links below
  • A copy of the valid or expired Foreign Passport, If available
  • A copy of the valid or expired Residential Permit, If available
  • One affidavit from self (applicant) and one affidavit from an Indian National testifying to the character of the applicant in the prescribed language available in the application form

Where does CAA not apply?

  • currently CAA 2019 does not apply to only Autonomous tribal-dominated regions in Assam, Meghalaya, Tripura and Mizoram.

 Follow this step by step guide for CAA 2024 application

1.Go to official website of CAA Online Portal India created to accept applications under this scheme. The website is indiancitizenshiponline.nic.in

2. There is an arrow showing where new CAA applicants have to apply. Click on ‘Submit Application for Indian Citizenship under CAA 2019’. You will be directed to new application page.

3. Enter you ‘email id’/ ‘mobile number’. Fill captcha and click ‘continue’.

4.Verification shall initiate by sending OTP to both e-mail and phone.

5. Sign in again by entering your mobile number and OTP. Fill captcha and click ‘submit’.

6.Click on ‘click here to initiate online filing of fresh of fresh applicant’.

7. A question appear on screen ‘Did you enter India on or before 31-12-2024′. Click yes.

8. More questions appear on the screen one by one. Like which country you belong to, your religion etc. Choose correct options.

9. Fill applicant’s details like Name, Gender, Date of Birth, Father’s name, Age etc. Click next. Upload your photo and signature. Enter Captcha and click ‘update’.Tap declaration box to show you have read the information Fill you address information.

  1. Enter your family information like name of parents, spouse, their address and nationality etc.

11.There is a section of providing information about criminal proceedings. Fill it and click ‘next’.

12. Click on document uploading option and submit copies of Schedule 1A, Schedule 1B, affidavit Schedule 1C, copy of valid or expired passport, evidence of Date of birth and any other based on your category.

13. Online Payment of Rs 50.
